General Conditions of Sale
1. Introduction
These General Conditions of Sale govern the sale of products offered through the website [ thesmallpattern.com ] (hereinafter "the Site"). The seller of the products is Pastina Srl, with registered office in Via Casilina 7L 00182 Rome RM Italy, tax code and VAT number IT17766391001, registered in the Rome Companies Register, REA no. RM - 1739945, (hereinafter "the Seller").
The Customer is defined as any natural person acting for purposes outside of any entrepreneurial, commercial, craft or professional activity they may carry out, who accesses the site to place an order (hereinafter "the Customer").
By placing an order on the Site, the Customer declares that he has read and fully accepted these General Conditions.
2. Object of the contract
This contract concerns the sale of tangible goods, in particular art prints and similar products made at the Customer's request, as described on the relevant product pages of the Site.
3. Purchase methods
To place an order, the Customer must follow the Site's guided procedure, entering their details and confirming the purchase. The contract is deemed concluded when the Seller receives the order confirmation from the Customer.
The Seller reserves the right to refuse or cancel orders that are incomplete, anomalous or fraudulent.
4. Prices and payments
All prices listed on the Site are in euros (€) and include VAT, unless otherwise indicated. Shipping costs are specified at the time of purchase.
Payment can be made using the methods available on the Site, securely.
5. Delivery times and methods
Products are made to order, and production times are approximately 1-3 business days. Deliveries are made via courier, according to the methods indicated at the time of ordering. Shipping times vary from 2 to 10 business days, depending on the destination and the chosen method.
The Seller is not responsible for delays attributable to force majeure, courier failures, or unforeseen events.
6. Right of withdrawal
Pursuant to Article 59, paragraph 1, letter c) of the Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply to custom-made or clearly personalized goods. Since the products sold are made to order, the Customer cannot exercise the right of withdrawal due to second thoughts.
7. Damaged or non-compliant products
In case of damaged, defective or non-compliant product, the Customer must contact the Seller within 7 days of delivery , providing:
- Order number
- Detailed description of the problem
- Photographic documentation
The Seller, after verifying the report, will provide a replacement or refund, at its discretion.
8. Customer Obligations
The Customer undertakes to provide truthful and correct information and to keep his/her access data to the Site confidential. The Seller cannot be held liable for damages resulting from incorrect information or accounts compromised by improper use.
9. Intellectual property
All content on the Site, including text, images, graphics, logos, and designs, is protected by copyright and remains the exclusive property of the Seller or their respective owners. Any unauthorized reproduction or use is prohibited.
10. Applicable law and competent court
This contract is governed by Italian law. Any dispute concerning the interpretation, execution, or validity of this contract will be submitted to the consumer's court.
